TERMS AND CONDITIONS

These terms and conditions govern the purchase and sale of products (“Product” or “Products”) through www.cdarluxury.com (the “Website”), our other sales platforms/mobile applications (“Application”), or in person at our office from CDAR LUXURY. They also apply to your utilization of any services or features provided by us or on our behalf, in conjunction with the App and Website. By placing an order for such Product(s) or by using our Services, you agree to be bound by and accept these Terms and Conditions. CDAR LUXURY TRADING LLC (EIN 35-2794583, registered office at 8 The Green Ste. B, 19901 Dover DE, United States of America) reserves the right to amend these terms and conditions for buyers. The latest version of the Terms and Conditions will be posted on this page, and it is advisable to review these Terms and Conditions before making any purchases or using our services. These Terms and Conditions are an integral part of the general terms and conditions governing the use of our services. Additionally, it is recommended to carefully review our Privacy Policy before placing an order for product/s or using our services.

Order acceptance and cancellation: Receipt of an order confirmation via the issued invoice does not confirm our offer to sell. We reserve the right to refuse or limit your order at any time, regardless of whether payment has been processed. If your order is canceled or limited, and payment has already been processed and subsequently canceled, we will promptly issue a refund to your original payment method for the full amount and inform you of the cancellation.

Exclusive orders or pre-orders: We have the option to offer exclusive designer orders, specific collections, and special pieces for pre-order, tailored to individual customers. These orders are processed at a later date when the product is ready for shipment. Once a pre-order and/or exclusive or made-to-order product is confirmed, changes to size, style, quantity, or product type cannot be made unless approved by the designer. Orders cannot be canceled or refunded unless approved. In the event of shipment delays, production changes, or cancellations by the designer, CDAR LUXURY will promptly inform you. Any requests for cancellation of pre-orders, exclusive, or custom orders may only be refunded as a credit voucher if approved by the firm, to be used for future purchases within the same firm.

Please refer to the PAYMENT TERMS below for detailed information on payment processing and order refunds. Once you receive your order, if you are unsatisfied with it, you cannot return it in accordance with our Return Policy.

Items by request or in stock: All products are purchased at the request of the customer, requiring payment before CDAR LUXURY makes the purchase of the requested item. Once the item is purchased, the delivery time is approximately 3-4 days. It’s possible that the requested product is already in stock in our offices or with another supplier. Until payment is received, the product may not be processed for shipment. The delivery time in such cases will be between 2-3 days.

  • Once an on-demand order is placed, it cannot be canceled or modified if payment has been processed. The order is non- refundable, but exceptions may apply; please refer to the refund policy for details. Any requests for cancellation or refund of purchases made in the client’s chosen boutique will only be refunded as store credit to be used at the purchased boutique. If the purchased item is in stock and payment has been made, cancellation or refund is not possible.
  • In the event that the received item is not in the expected condition, we will make every effort to exchange it for a new

  1. Payment Terms: Payment terms at CDAR LUXURY are determined solely by our discretion and, unless otherwise agreed upon in writing, adhere to the following guidelines:
  • Delivery or shipment of any requested item or service will only occur upon receipt of
  • Payments made via debit/credit cards or in currencies other than Euro will undergo currency conversion using the rate from xe.com on the transaction day. CDAR LUXURY does not cover or split currency exchange charges. It is your responsibility to ensure payment of the exact amount specified in the invoice. You acknowledge that CDAR LUXURY bears no responsibility for any credit shortfall due to currency conversion fees.
  • Clients are responsible for any fees related to payment
  • For pre-orders or styling services, you may be required to pay the full purchase/service price or a percentage as a down payment upon ordering/service initiation. Upon completion of the initial payment and readiness of the product/service for delivery, the remaining balance, alongside any shipping/transportation fees, taxes, or duties, will be charged.
  • Failure to process the remaining payment will result in the non-fulfillment of your order/service, and the total payment made will not be refunded.
  • Pre-order items may take 4-6 months to be delivered from the order date to the shipping date. The estimated delivery date will be provided upon placing and confirming the pre-order or special order.

If the remaining payment can’t be processed, your order or service will not be issued and the total paid will not be refundable. Changes in products, services and prices: At CDAR LUXURY, we are constantly updating and revising our offerings of Products and Services, and we reserve the right to discontinue them at any time without prior notice. All pricing for our Products is subject to change. We retain the right to make adjustments to prices and Products and Services due to changing market conditions, Product discontinuation, manufacturer price alterations, errors in advertisements, and other extenuating circumstances. While we strive for accuracy in Product descriptions and pricing, we cannot guarantee their absolute precision. In the event that an error in pricing or description of a Product is discovered, we reserve the right to refuse or cancel any orders placed for the affected Product. This right extends regardless of whether the order has been confirmed, and your credit or debit card has been charged.

SHIPPING TIMINGS

CDAR LUXURY delivers worldwide. Our customers can choose between different shipping options and couriers:

  • Express delivery by DHL Express or FedEx from 1 – 5 Working Days (depending on location). National shippings with Same-Day delivery and EU shippings with Next-Day delivery available service upon request.
  • Personal hand deliver service provided by our shipping assistants and logistics
  • Impeccable bespoke shipping worldwide service based on responsiveness, discretion and utmost security provided by Malca Amit, a global expertise and tailor-made solutions, successfully applied to Luxury.

How does the hand-to-hand delivery work?

It is as easy as telling your sales manager where and when you want to receive your much-desired orange box and one of our shipping assistants will be delighted to deliver it to your doorstep.

The advantage of hiring this service is that you can see the bag before buying it, verify its authenticity and pay at the same time.

We love to hand-deliver all your orders because, in addition to having the opportunity to meet our customers around the world, it gives us great satisfaction to witness and share such a special moment as seeing the happiness of our clients when they receive and open their purchases.

SHIPPING POLICY

CDAR LUXURY delivers worldwide. Our customers can choose between different shipping options and couriers. These shipping terms apply to national and international shippings and are accepted by the customer once the order is placed. Please see here our detailed shipping timings.

  • All orders placed Monday through Friday will be processed and shipped within 1-2 business days, unless informed
  • Orders placed over the weekend or on holidays will begin processing the next business day and will ship within 2-3 business
  • During periods of high volume of demands or holidays, it may be that certain products may have longer processing and delivery times than usual.
  • You will receive a confirmation email with your tracking

  • The prices of products and services listed on the invoice may not be final in some cases. Therefore, CDAR LUXURY does not cover arrival fees at the destination or any additional shipping charges.
  • All shipments are handled by DHL Experess without insurance unless specifically requested by the customer, who will bear the extra cost. If insurance is required for a purchased product, the customer will be notified by CDAR LUXURY and will be responsible for it. CDAR LUXURY is not liable for any lost, theft or damage while in transit, if insurance was not contracted or the client decided not to declare the true value of the item.
  • Shipping prices are calculated based on the volume and weight of the shipping box, as determined by the transport agency’s rate. The price is communicated to the customer before the purchase, and it is included in the invoice issued by CDAR
  • If the product is imported into the European Union, the customer is responsible for all import duties, customs, and local sales taxes charged by the destination country. Payment of these amounts will be required to release the order from customs upon arrival. Orders are dispatched from the country where the requested item is located. CDAR LUXURY will inform customers of the shipment’s origin before purchase if it’s not from the European Union or the United States of
  • Some products may be subject to import duties, for which CDAR LUXURY does not cover the fees upon arrival. Additionally, all non-customs-related local taxes are the customer’s responsibility. CDAR LUXURY is not liable for reporting or paying additional local taxes, such as use tax. Taxes and duties are calculated based on the total value of the merchandise.
  • In the case of returns or exchanges, shipping and any reverse fees are the customer’s

RETURNS AND REFUND POLICY

CDAR LUXURY does not offer refunds for the amount of the item, and the costs of service, shipping, taxes, or import/export duties paid are non-refundable in accordance with this Return Policy. Customers are responsible for these charges. Subject to certain conditions or exceptions outlined below in this return policy, and unless expressly stated otherwise:

  • Shipping Lost: If a package is lost and insurance was not chosen or shipping was not declared with the real value, CDAR LUXURY will not refund the item’s amount or shipping costs.
  • Refund with “Credit or Voucher”: If customers are unsatisfied with received items and wish to keep the amount paid as credit or voucher for future purchases, this option is possible only if the item was purchased from a boutique that authorizes returns in the form of a voucher. CDAR LUXURY is not responsible if the boutique/supplier does not authorize the return. This option may not be available if the item was provided through a supplier or team member from another country, or if it exceeds the return deadline. In all cases, customers are responsible for management, shipping, and return costs, which are non- refundable. Items returned damaged, without packaging materials, or altered will not be Credit returns are processed after items are returned and inspected.   • Deposits: Deposits will be returned in the same manner they were made. Pre-order deposits are non-refundable unless authorized by the purchasing firm. Service and shipping costs are non-refundable.
  • Faulty Products: Damaged or defective products must be reported within 10 days of receipt. Items damaged from normal wear and tear are not considered defective. CDAR LUXURY TRADING LLC and the purchasing firm will determine if the damage is due to normal wear and tear. Damaged or defective products will be replaced or repaired, subject to availability. Customers are responsible for return and shipping costs of the repaired item. Refunds for the item’s amount or management costs are not possible.
  • Markdowns or Outlet Items: No returns or refunds are accepted for promotional or sale
  • Late Returns: Products returned outside the return period may not be
  • Color Products: While efforts are made to display accurate colors, CDAR LUXURY cannot guarantee exact color representation. Customers with color concerns should contact us before placing orders.
  • Final Sale: Certain items cannot be returned, exchanged, or refunded except as required by All products must be returned in original packaging.

SPECIAL PRODUCTS OR ORDERS

From time to time, we may offer for sale certain “SPECIAL Products,” which are products or experiences available at a limited-time pre-sale event. This allows you to place orders or inquiries from specific designers or vendors specially selected by us, with quantity limitations, and designed for an exceptional experience, and that the applicable provider (“EP Provider”) will supply, deliver, provide, fulfill, and/or execute (“EP Fulfillment”) at one or more subsequent times. Exceptional Products are also subject to, and by placing an order for an Exceptional Product, you agree to the following additional terms and conditions:

  • Special products are available on a first-come, first-served
  • Special products can be purchased in two ways: directly from us or directly from the EP If you buy a Special Product directly from us:

All special product sales are final and non-refundable (subject to applicable law and availability of EP Suppliers), and resales are prohibited. However, you can gift your purchase of an exceptional product to someone else, provided that you give us notice of the recipient’s contact information, with your permission, prior to finalizing your order. Any sales taxes, duties, import taxes, or similar charges will be determined based on the recipient’s address and will be collected at the time of payment of the balance.

If the purchase price of a special product is not charged in full at the time of your order, to finalize your purchase (and without prejudice to any order confirmation/payment or communication page), you must pay any balance (including any applicable duties, taxes, VAT, or similar charges) in full within 72 hours, unless a longer period is indicated on the exceptional product detail page. We will contact you immediately at the email address or phone number provided. If you do not pay the balance in full within the applicable time period, we reserve the right to cancel your order, return any deposit, and offer the exceptional product for sale publicly.

In accordance with your purchase of a special product, we will provide the relevant EP Provider with your name (or that of the designated recipient) and contact information so that the EP Provider can perform EP Fulfillment. You give us permission to share such information (or your designated gift recipient’s contact information, and confirm that you have their permission for us to share such information) with the EP Provider for the purposes of EP Compliance and to cooperate and assist in EP compliance as we deem necessary or appropriate.

Between you and us, the EP supplier is solely responsible for EP compliance, and we are only responsible for collecting payment from you for the exceptional product and for using our commercially reasonable efforts to confirm your order with the EP supplier. If the EP provider does not confirm your order for any reason, we will refund the full amount.

If you buy a special product from the EP supplier:

Upon your inquiry and confirmation of your intention to purchase the exceptional product, we will provide the relevant EP supplier with your name (or that of your designated recipient) and contact information so that the EP supplier can finalize the order as deemed necessary or appropriate, collect payment, and perform EP compliance. You give us permission to share such information (or your designated gift recipient’s contact information, and confirm that you have their permission for us to share such information) with the EP provider for the purpose of negotiating and finalizing your order. For clarity, such orders are not final or confirmed until accepted by the EP provider in accordance with their applicable processes, terms, and conditions. Between you and us, the EP Supplier is solely responsible for EP compliance and collection of payment for the Exceptional Product and any applicable sales taxes, VAT, duties, import taxes, or other government charges and fees, but we can cooperate and assist you and/or the EP Provider in complying with EP compliance as we deem necessary or appropriate.

EP compliance will take place at the time and in the manner specified on the special product detail page and at the reasonable discretion of the EP supplier, and as agreed by you or us with the EP supplier. If EP compliance is delayed or canceled due to events beyond the reasonable control of the EP provider, the EP provider may, at its discretion, issue a refund or reasonably reschedule, defer, or modify EP compliance.

The price of a special product covers only the cost of the special product. Unless expressly stated otherwise on the exceptional product detail page, the price does not include sales taxes, VAT, import taxes, duties, or any travel, accommodation, meals, services, documentation, insurance, registrations, modifications, customization, or government fees or charges. If the EP Supplier offers or permits you to make customizations or modifications to or in connection with the exceptional product or EP compliance, any applicable costs or expenses (and any related taxes or charges) are your sole responsibility, and you agree to pay such totals at the request of us or the EP provider. We do not provide any warranties regarding the exceptional product or EP compliance.

You agree that we are not responsible and expressly agree to waive and release all claims, now known or known in the future, against us and our affiliates and our and their employees, owners, shareholders, directors, officers, agents, and representatives against any claim, charge, liability, loss, injury, damage, and cost, in each case, in connection with your purchase of an exceptional product and EP compliance.

You are responsible for complying with all applicable laws, rules, and regulations in relation to the special product and your participation in EP compliance. We do not guarantee that special product descriptions are complete or accurate and may be subject to reasonable changes at the EP supplier’s discretion. Compliance with EP may be subject to additional terms and conditions by the EP provider, and you are responsible for reviewing, agreeing, and complying with those terms.

GIFT CARDS

Gift cards are available for purchase. They are valid for 1 year from the day of purchase. If you want to extend the expiration and the card expires, you must inform us 1 month before the end of this period. For help using it or extending the expiration, contact our team at contact@cdarluxury.com.

INTELLECTUAL PROPERTY AND CONTENT

All copyrights, designs, trademarks, and all other intellectual property visible through our services, including the CDAR LUXURY software and all HTML code and other codes contained on our website and application, are the exclusive property of CDAR LUXURY TRADING LLC or its proprietary owners. You are permitted to use the content of the services only as expressly authorized by CDAR LUXURY and/or its third-party licensors. Any reproduction or redistribution of the aforementioned content without permission is prohibited and may result in civil and criminal penalties, where “Content” is defined as data files, graphics, text, photographs, drawings, logos, images, sounds, music, video, or audio files on the website. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works, transfer, or sell any content, software, products, or services included in the services. You may not use the services, or any of their content, to promote any commercial purpose, including any advertising or advertising revenue-generating activity on your own site(s).

LIMITATION OF LIABILITY

In no event will we or our suppliers have obligations or liabilities to you or any other person for loss of profit, loss of business or use, or for incidental, punitive, special, or consequential damages, whether by contract, tort (including negligence), product liability, or any other theory or form of action, even if we have been informed of the possibility of this arising out of or in connection with the sale, delivery, or use of the products or services. Our sole and total maximum liability (and the liability of our suppliers) for any reason, and your sole and exclusive remedy for any cause, will be limited to the actual total paid by you for the products that you have ordered through our services. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages.
